First 'Dreamer' Deported Under Trump

A man who is believed to be the first undocumented immigrant to be deported under the Trump administration despite having permission to live and work in the United States filed a lawsuit Tuesday, alleging he hasn't been told why he was sent back to Mexico just hours after his arrest.

U.S. Customs and Border Protections officers appear to be ignoring the protections still on the books from Obama's term and instead are listening to Trump's anti-immigrant rhetoric.

A case involving a man who was deported to Mexico despite having permission to be in the US under a program that shields young immigrants has landed in the courtroom of a judge whose impartiality was questioned by Donald Trump during the presidential campaign because of his Mexican heritage.

WASHINGTON ― Immigrant rights advocates were dismayed on Tuesday by reports that the first undocumented immigrant with active Deferred Action for Childhood Arrivals protections was deported under President Donald Trump.

Federal immigration agents detained Juan Manuel Montes on February 17 in Calexico, Calif., USA TODAY reported.

King is an immigration hawk who staunchly opposes the Deferred Action for Childhood Arrivals program, or DACA, and any other protections for so-called Dreamers, undocumented immigrants who came to the U.S.as children. He'd been living in the United States since he was nine. Lawyers for the Dreamer said in a complaint that Border Patrol agents pressured him to sign documents approving his removal that he did not understand, and they didn't provide him copies, allow him to see a lawyer or put him before a judge.

"Juan Manuel was funneled across the border without so much as a piece of paper to explain why or how", said Nora Preciado, one of the attorneys with NILC.

According to the complaint, Montes came to the U.S. when he was 9 and suffers from a cognitive disability due to a brain injury.

After getting assaulted in the Mexican border city of Mexicali, Montes returned to the United States two days later and turned himself over to authorities, according to the lawsuit.

He pursued a welding degree from a community college and worked as a farmworker for about two years in California and Arizona.

Even after its latest statement, Homeland Security's account sharply differed from what Montes' attorneys say happened.

Three hours later, he was deported to Mexico.

The government has issued almost 800,000 DACA permits since President Barack Obama introduced the program in 2012 and almost 700,000 renewals.
