GOP senator: Flynn 'not cooperating' in Russian Federation probe

Lawyers representing former White House national security adviser Michael Flynn have not indicated whether or not they will comply with the Senate Intelligence Committee's subpoena for documents related to his communications with Russian officials during the 2016 presidential race and the transition period of President Donald Trump.

Republican Sen. Richard Burr of North Carolina told reporters that Flynn's lawyer has informed the panel he will not abide by a subpoena for private documents.

Burr noted later Thursday, though, that it's possible Flynn has not yet definitively decided whether he will comply with the subpoena or not.

Congressional aides told Reuters the committee was still negotiating in the hopes of obtaining the requested documents. Those letters sought a wide array of electronic and paper records related to any contacts people affiliated with the Trump campaign had with Russian officials and Russian businesses.

Burr added that the committee, which is investigating Russia's interference in the 2016 election, would be evaluating its next steps.

The relevant statute, 2 U.S.C. § 194, directs the President of the Senate (Vice President Mike Pence or, in his absence, president pro tempore Orrin Hatch) to certify the contempt statement of facts to the "to the appropriate United States attorney, whose duty it shall be to bring the matter before the grand jury for its action".

The top Democrat and Republican on a House oversight committee have said Flynn likely broke federal law by failing to get approval from the USA government to accept foreign payments, including $33,000 in 2015 from RT, Russia's state-sponsored television network.

He has been under investigation by the FBI for secretly working as a paid lobbyist for Turkey during the presidential campaign, a fact he disclosed to the White House weeks before Mr. Trump's inauguration, according to a Wednesday New York Times report.

That same day, Flynn told friends, "I just got a message from the president to stay strong", Yahoo News reports.

Despite the disclosure, Trump appointed Flynn as his national security adviser.

Flynn is faced with mounting legal bills, and held a meeting with friends to try to spur more work for his lobbying firm. The U.S. has rebuffed those calls. That inquiry is looking into whether Flynn was fully forthcoming about his foreign contacts and earnings from organizations linked to the governments of Russian Federation and Turkey.
