India in appeal to United Nations court to halt execution of 'spy'

India and Pakistan are fighting their cases at the International Court of Justice (ICJ) at The Hague over the Rawalpindi military court's death sentence to an alleged Indian spy.

Representing India's stand before the 11-judge bench of the global justice body, India's agent to the court, Deepak Mittal said that despite repeated requests, Pakistan denied consular access to Kulbhushan, which is in contravention of Vienna convention.

Union Minister of State in the Prime Minister's Office (PMO) Jitendra Singh on Monday reassured everyone that Indian national Kulbhushan Jadhav will get justice in the International Court of Justice (ICJ).

India mentioned in the application that Pakistan is in violation of the Vienna Convention by denying consular access to Jadhav.

Kulbhushan Jadhav was previous year arrested by Pakistan and was awarded capital punishment without carrying out any "fair trial".

Jadhav was "an innocent Indian national, who, incarcerated in Pakistan for more than a year on concocted charges, deprived of his rights and protection accorded under the Vienna Convention, has been held incommunicado. and faces imminent execution", Indian lawyer Deepak Mittal told the tribunal on Monday. Salve also said Pakistan did not even provide copies of chargesheet and military court's verdict to enable India to appeal against his death sentence.

Attorney General Ashtar Ausuf is leading Pakistan's defence. We will make sure he is not sentenced to death.

However, Islamabad suffered a jolt when it was not allowed by the court to play the video containing a purported confession by Jadhav, a former navy official, who India says was abducted from Iran and taken to Balochistan.

Britain's Crown Prosecution Service said that breach of bail is punishable by up to a year in prison or a fine. Both U.S. and British officials have declined to comment on whether there is a warrant for Assange's arrest.

India presented a powerful testimony ahead of the 11-judge bench at International Court of Justice (ICJ) in Hague, Netherlands.

On May 8, India moved the ICJ against the death penalty handed down to Jadhav.

"We are hopeful we will soon be able to see Kulbhushan in our midst", said a classmate who studied with Mr. Jadhav at the King George School in Dadar.

'The execution of the death sentence can not be done while this court is hearing the appeal.

"We have highlighted the contradictions in Pak Foreign Minister Sartaj Aziz's statements of March 3 and April 10, when he first said there was insufficient evidence against Jadhav".

India demands suspension of Jadav's death sentence. On May 9, ICJ gave Jadhav a lease of life. India has denied that he has any connection with the government.

India has further claimed that Jadhav was kidnapped from Iran where he was involved in a business undertaking.
