Political parties welcome ICJ's order on Jadhav

The World Court ordered Pakistan on Thursday not to execute Indian citizen Kulbhushan Sudhir Jadhav, convicted of spying, until it hears a case brought by India arguing that Islamabad violated a treaty guaranteeing diplomatic assistance to foreigners accused of crimes.

The ICJ also instructed Pakistan to take all "necessary measures at its disposal" to ensure that Jadhav was not executed pending a final decision by it. Domestically, the Pakistan Army, rather than the civilian government, will find itself on the back foot after the ICJ judgment because it was prosecuting Jadhav.

Pakistani authorities say Jadhav confessed to being assigned by India's intelligence service to plan, coordinate and organise espionage and sabotage activities in Baluchistan "aiming to destabilise and wage war against Pakistan".

A senior official in the law ministry told the Express Tribune that Pakistan's lead lawyer Qureshi made two mistakes.

Foreign office spokesman Nafees Zakaria also hit out at India, saying the country has been "trying to hide its real face" by taking the case of Jadhav to ICJ.

"We will be pursuing consular access for him".

Islamabad has also noted that Jadhav's sentence remains subject to appeal and he is no immediate danger of execution. He spoke to External Affairs Minister Sushma Swaraj to thank and appreciated efforts of advocate Harish Salve, who represented India in Jadhav case.

Earlier in the day, the ICJ had announced its verdict on the Kulbhushan Jadhav case and had dismissed Pakistan's claim that it did not have jurisdiction over the matter. "Today by taking the matter to the worldwide court, and ensuring that we claim our rights on the global stage, Prime Minister Modi has sent a signal to the entire world that every citizen's life matters to us and India shall not bow down countries like Pakistan which has denied the basic rights to our citizens", Rao asserted.

Indian Attorney General Mukul Rohatgi described the court's decision as a victory. He added that the ICJ verdict had shown that the military court trial by Pakistan was a "charade", and that the neighbour had been completely "blown away" by it.

She said the case from Pakistan's side was not well prepared.

Responding to a question, Rohatgi asserted that the ICJ's interim verdict on Thursday was binding on both India and Pakistan.

According to former Pakistan Bar Council Vice Chairman Farogh Naseem, Pakistan should have immediately withdrawn its March 29, 2017 declaration accepting the compulsory jurisdiction of the ICJ.

While presenting arguments, Pakistani counsel had informed ICJ that Jadhav, 46, was arrested in March a year ago in the restive Balochistan province.
