What Happens if Flynn Ignores the Senate's Subpoena?

White House National Security Advisor Michael Flynn walks down the White House colonnade on the way to Japanese Prime Minister Shinzo Abe and President Trump's joint news conference at the White House.

Senators slapped Flynn with a subpoena last week in their investigation into ties between President Donald Trump's campaign associates and Russian interference.

Burr says he would welcome Flynn's willingness to cooperate.

The report, which cited two people familiar with the case, said Flynn informed the transition team's chief lawyer about the probe on January 4, much earlier than previously reported.

Last month, the top Democratic and Republican members of the House Oversight Committee announced that Trump's failure to disclose the payments he received from foreign governments likely constituted a violation of US law.

"Gen. Flynn's attorneys have not yet indicated their intentions regarding the Senate Intelligence Committee's subpoena", Burr said through a spokesperson, according to ABC News.

"General Flynn has a story to tell, and he very much wants to tell it, should the circumstances permit", said Flynn's lawyer, Robert Kelner.

On Tuesday, Deputy Attorney General Rod Rosenstein, the No. 2 Justice Department official, named former FBI Director Robert Mueller to also investigate allegations of ties between Trump's 2016 presidential campaign and Russian Federation.

The Oversight Committee had asked the White House to provide it with Flynn's security clearance paperwork, receipts from payments he received from foreign governments, and other documents related to the hiring and firing of the former national security adviser.

The district court route would entail the Senate passing a resolution authorizing civil action that could lead to Flynn being charged with contempt of court.

As national security adviser, Flynn held several phone calls with Russian ambassador Sergey Kislyak before Trump's inauguration and immediately after. It is also unclear whether, given the subject matter, there is any reason the Senate could not determine that Mueller is the appropriate U.S. Attorney for the matter.

Sen. Ron Wyden (D-Ore.) didn't want to get ahead of the intelligence committee leaders, but said he plans to look into "tools" the Senate can use to pressure Flynn.

"The criminal contempt process takes forever - you vote [for] it and then it goes to the USA attorney and he has to decide what to do with it", senior counsel Stanley Brand of the Akin Gump firm told Politico.
