Cosby trial judge tells jury to deliberate as long as willing

Bill Cosby shakes hands with his lawyer Brian McMonagle as they leave the Montgomery County Courthouse during Cosby's sexual assault trial, Thursday, June 15, 2017, in Norristown, Pa.

"I want to reiterate how proud I am of each and every one of you", O'Neill said as he sent the sequestered jury back to the hotel.

The jury in the Bill Cosby trial indicated Thursday that it has not been able to come to a unanimous decision.

The twelve jurors - seven men and five women from the Pittsburgh area - began deliberations on Monday and are attempting to determine whether Cosby is guilty of three counts of of aggravated indecent assault.

The testimony is relevant because Cosby is charged with giving pills to Constand, a former Temple University employee, to incapacitate her before their sexual encounter.

If the former comedian is convicted, Cosby could face a maximum of thirty years in prison.

The prosecution spent a week presenting its case, and the defense less than a day.

After almost two weeks of testimony, the 12 original members of the jury remained - no alternates were needed.

Jurors deciding Bill Cosby's fate at his sexual assault trial resumed deliberations on Friday morning and will try to break a deadlock on all three charges. After the declaration of a mistrial, prosecutors may choose to retry the case with a different set of jurors, or they may cut their losses.

At the start of the deliberations, the jurors also wanted to revisit Cosby's old descriptions of his relationship with Constand and the testimony of the Canadian police officer who took down Constand's initial report back in 2005.

Prosecutors relied on the testimony of a second accuser, Kelly Johnson, as well as Cosby's own words to make the argument that he is a serial offender.

"It's obviously going to be hard after this many hours of deliberation", former prosecutor Dennis McAndrews, who has been monitoring the trial, said of the chance they reach a verdict.

Cosby's spokesman, Andrew Wyatt, says the impasse shows that jurors are "conflicted about the inconsistencies" in accuser Andrea Constand's account.

The trial comes after repeated efforts by Cosby's lawyers to have the charges thrown out.

The third count accuses Cosby of impairing Constand "by administering drugs, intoxicants or other means for the objective of preventing resistance".

In his decade-old depositions, Cosby said he gave Constand Benadryl, a common allergy drug whose side effects can include drowsiness.

The case has already helped demolish Cosby's nice-guy reputation as "America's Dad".

"While you should not hesitate to re-examine your own views and change your opinion if you are convinced that your opinion is erroneous, do not feel compelled to surrender your honest belief as to the weight or effect of the evidence exclusively because of the opinion of your fellow jurors, or for the mere objective of returning a verdict", O'Neill said.

Art Patterson, a veteran jury consultant and social psychologist with the New York-based trial consulting firm DecisionQuest, told Fox29 that, "it's rare that juries go for more than a couple days".

Cosby's lawyer said he and Constand were lovers sharing a consensual moment of intimacy.

But the defense team for Cosby, who did not testify, sought to portray his sexual encounter with Constand as romantic.

Cosby's spokesman said the impasse showed that jurors doubted Constand's story.
