"That simply can not be", Judge Derrick Watson wrote in his decision on July 14.

The decision will permit "grandparents, grandchildren, brothers-in-law, sisters-in-law, aunts, uncles, nieces, nephews, and cousins of persons in the United States" to qualify as close family and should be granted entry into the country as exempts from the travel ban, according to CNN.

In response, the Justice Department said Judge Watson's ruling "empties the [Supreme] Court's decision of meaning, as it encompasses not just "close" family members but virtually all family members", according to the court filing, as reported by Reuters.

In his ruling, Watson touted the superiority of his own definition above that of the Trump administration, asserting: "The Government's definition represents the antithesis of common sense".

With the ruling, the order banning travelers from six Muslim-majority countries identified as hotbeds of terrorism is back in effect with the exception of those who have bona fide relations to USA citizens or institutions etc.

"We are processing visa applications for nationals of the six affected countries as directed by the Executive Order and to the extent permitted by court decisions", the official said. The Trump administration interpreted that exemption as applying only to immediate family members such as a parent, spouse, fiancé, son, daughter, son-in-law, daughter-in-law, or sibling.

The Trump administration is seeking to close a legal window opened for tens of thousands of refugees to enter the United States, appealing a federal judge's order directly to the Supreme Court.

Judge Watson initially said that it was up to the Supreme Court to clear up its ruling, but late Thursday he issued a new opinion ruling that the administration's latest policy was too strict. "Judge Watson's order renders the Supreme Court's decision all but a dead letter".

The Supreme Court has agreed to hear oral arguments in the fall over whether the ban violates the U.S. Constitution.

"Posts should therefore reconsider and readjudicate a visa application refused exclusively based on the E.O.in which the applicant contacts the consular section claiming to have a close family member that exempts them from the E.O. on the basis of the new guidance", according to the cable that Reuters obtained.
