However, the Justice Department said on Wednesday that the document was a job posting relating to only one complaint and not a part of a larger effort.

But Isgur Flores reportedly said that the department's investigation would focus only on the 2015 complaint, in which 64 Asian-American groups accused Harvard of employing an "unlawful use of race in the admissions process", according to a copy of the formal complaint shared by the Chronicle of Higher Education.

A study by a Princeton University academic found that Asian-American students had to score 140 points more than whites in the SAT to gain admission to elite universities. The complaint accused Harvard University and other Ivy League institutions of discriminating against Asian-American students in the admissions process. "The Department of Justice is committed to protecting all Americans from all forms of illegal race-based discrimination".

The pending suit, filed by the group Students for Fair Admissions, "is clearly aimed for the Supreme Court", the New York Times reports.

Out of the 2,056 applicants accepted, 50.8 percent identified as minorities.

Advancing Justice opposes quotas for and discrimination against Asian Americans, and we support affirmative action programs, which allow admissions officers to evaluate applicants holistically. Though the Justice Department has never sued a college or university over its affirmative action policies, it may choose to join the lawsuit against Harvard, she said.

These exacting requirements may lead Harvard into a scathing and intrusive investigation under an administration which is no longer friendly to affirmative action, suggests Banzhaf. The New York Times reported that the Trump administration meant to increase the Justice Department's efforts to target universities whose admission policies it deemed discriminatory against white applicants, a report in The Harvard Crimson, a student newspaper of the university, said.

"Under this cloud, even a few positive measures within the Justice Department are met with suspicion by many civil rights leaders", Levin said.

Under former President Barack Obama, the Education Department dismissed a similar complaint by another organisation, while the Justice Department did not follow up on the complaint made to its Office of Civil Rights that is now being taken up for review.

"They can initiate [litigation] all they want, but the law of the land is that individualized treatment of applicants is appropriate and will not be challenged or should not be challenged, but will pass muster", he said.
