U.S. solar trade case moves on, panel finds harm to producers

The U.S. International Trade Commission's preliminary finding that imports harmed U.S. manufacturers means President Donald Trump will get to decide whether to slap sanctions on foreign solar panels and modules or take other actions. After a trade complaint by SolarWorld led to tariffs on imported panels from China in 2012, companies including JinkoSolar Holding Co. and Trina Solar Ltd. opened factories in Malaysia, Vietnam and elsewhere to avoid paying duties.

The unanimous vote Friday by the International Trade Commission sets up the possibility that the Trump administration will impose tariffs that could double the price of solar panels from overseas. Rooftop installers and solar-farm developers, which employ 85 percent of the industry's 260,000 workers, have been especially vocal, saying higher-priced panels would lead to widespread job losses. The company, which is majority owned by Hong Kong-based Shunfeng International Clean Energy Ltd., was joined in its petition by the USA arm of Germany's SolarWorld AG.

The motion was opposed by broad swaths of the solar power industry. "President Trump can remedy this injury with relief that ensures US energy dominance that includes a healthy USA solar ecosystem and prevents China and its proxies from owning the sun".

The four governors are from Colorado, Massachusetts, Nevada and North Carolina, all of which were in the top 10 solar markets in 2016.

The United States invented photovoltaic technology and accounted for more than a quarter of global solar manufacturing as recently as 2001. Solar advocacy group Solar Energy Industries of America (SEIA) says that Suniva's requested tariffs could cause the industry to shed 88,000 jobs.

A group of former US military officials also urged the Trump administration to reject solar tariffs, noting that the Defense Department is the nation's largest energy consumer and follows a federal law calling for the Pentagon to procure 25 percent of its energy from renewable sources by 2025.

Suniva and SolarWorld call those claims overstated.

SolarWorld employs about 300 people in OR, down from 1,300 at the peak, Mr Brightbill said.

"We brought this action because the USA solar manufacturing industry finds itself at the precipice of extinction at the hands of foreign market overcapacity", the company, which is based in Georgia, said the statement.

"Solarworld looks forward to rebuilding, ramping back up to full capacity and expanding to meet the growth in USA solar demand", he said.
